General travel conditions

Terms of use
These conditions of use govern the use of the site www.nature4fun.it (“Site”) by the user and the sale of tourist services offered in the electronic catalogs of EGMONT VIAGGI (by way of example, but not limited to, excursions, stays, tours, hotel nights) available on the Site (“Excursions”) starting from 30/05/2021. The General Conditions constitute a binding agreement between EGMONTVIAGGI and the user who uses the Site, books and purchases the Services (the “Customer”). The Customer is also subject to the particular conditions applicable to the individual services (including details on the destination, the date of departure and the duration of the holiday, the price, applicable taxes) which are specified in the EGMONT VIAGGI online catalogs. These particular conditions form an integral and substantial part of the contract between EGMONT VIAGGI and the Customer. The use of the Site, the reservations and the purchase of the Services are subject to the acceptance of these General Conditions by the Customer. The Customer is therefore required to read and expressly and fully accept the General Conditions as well as any special conditions applicable to the individual Services, by ticking the appropriate box or clicking on the hypertext link provided for this purpose. In the absence of acceptance of the General Conditions and any special conditions applicable to the individual Services, it will not be technically possible to confirm the booking and purchase the Services. The General Conditions provide for a different discipline depending on whether the Customer purchases the Services unitarily or as part of a “tourist package”. By “tourist package” we mean, pursuant to art. 34 of Legislative Decree 23 May 2011 n. 79 (“Tourism Code”) the service resulting from the combination of at least two of the elements indicated below, sold or offered at a flat rate:

• transport
• accommodation
• tourist services not ancillary to transport or accommodation which constitute a significant part of the tourist package.

These Terms of Use are in force starting from the update date indicated above.
The Terms of Use may be changed at any time, without notice, it being understood that such changes will not be applied to orders placed by the Customer before the change. Therefore, the Customer is required to carefully read the current text of the General Conditions before making the booking and purchase of the Excursion Services.

Registration on the site
Registration is allowed only to consumers who are natural persons, who are of legal age. By “Consumers” we mean natural persons who access EGMONT VIAGGI for purposes not related to any commercial, entrepreneurial or professional activity carried out. The provisions contained in the Legislative Decree n. 206 of 6.9.2005 of the Consumer Code, in the Tourism Code as well as those generally applicable to the type of service provided by EGMONT VIAGGI by virtue of Legislative Decree. n. 70 of 9.4.2003 on information society services and electronic commerce. In order to use the Site, the Customer must register by filling out the form with their personal data. The Customer will also be asked to enter their e-mail address and to enter a secret password. The e-mail address and password will act as authentication credentials (“Authentication Credentials”) to be able to access all the features of the Site and the Services. The Customer declares and guarantees that all personal data and information provided as part of the registration process are up-to-date, complete, truthful and correct. The Customer undertakes to promptly notify EGMONT VIAGGI of any changes to their registration data. Furthermore, the Customer authorizes EGMONT VIAGGI to verify the truthfulness and correctness of the registration data and other information provided and undertakes to cooperate with EGMONT VIAGGI for the successful outcome of these checks. If the Customer becomes aware of any unauthorized use of the Authentication Credentials and / or of any violation of the confidentiality of the password, the Customer must promptly inform EGMONT VIAGGI of the situation. The Customer is solely responsible for accessing the Site using the Authentication Credentials and is directly liable for any damage or prejudice caused to EGMONT VIAGGI or to third parties by improper use, loss, misappropriation by others or lack of protection. adequate secrecy of their Authentication Credentials. All operations carried out using the Authentication Credentials are considered to be carried out by the Customer to whom the Authentication Credentials refer. EGMONT VIAGGI reserves, at its discretion and at any time, the right to:
– terminate the contract with the customer in case of improper use of the site or contrary to the terms and conditions of sale signed.
– refuse the registration of new Customers or cancel existing Authentication Credentials, without this implying the obligation to communicate the reasons for such decisions or the right to indemnity or compensation.

Duration of the offer
EGMONT VIAGGI tourist services offers are normally valid for as long as they are present on the Site, until all available places are exhausted unless otherwise indicated in the offer itself, and may vary in real time. The photos shown in the descriptions are purely illustrative and have no binding value.

Prices and taxes
EGMONT VIAGGI offers the Services at special, negotiated and public prices. The descriptions of the Services shown in our electronic catalogs specify for each type of travel and service the services included in the price and any special conditions applied to said services. The prices indicated are those in effect at the time of booking. All our prices are indicated in Euros and include VAT. In accordance with the VAT regime of travel agencies (Article 74ter of the Decree of the President of the Republic of 26 October 1972, no. 633), all invoices issued by EGMONT VIAGGI do not show the VAT collected on the services sold. The flat rate for trips and stays varies according to the period, the number of participants and the carrier. Our prices are contractual rates. Therefore, no dispute relating to the price of the tourist package can be raised after the booking has been made. Unless otherwise indicated in the offer, the prices do not include:

• optional and / or supplementary insurance
• the taxes requested by some municipalities and / or tourist areas
• meals not included in tourist packages
• drinks consumed with meals
• entrances to museums and sites
• paid activities
• personal expenses
• tips for use by guides and drivers during the tours

The price and / or the discount percentage indicated next to the sale price are established by EGMONT VIAGGI.

Extraordinary price changes pursuant to art. 40 of the Tourism Code.
EGMONT VIAGGI reserves the right to increase the price of the package according to any changes concerning:

• the cost of transport, depending in particular on the cost of fuel and the various applicable taxes, the amount of which varies according to the destination, and which are subject to change by the local authorities. The price changes will be calculated as the difference between the rates existing at the time of booking and the new official rates communicated by the competent authorities and by the transport service providers.

Reservation
We only consider irrevocable orders. In particular, we will be able to electronically accept the booking of a Service by the Customer and process the related order, only after the Customer has accepted the General Conditions and any special conditions applicable to the individual Services as well as after the communication of his number. credit card. In case of booking via the Internet, the General Conditions will be proposed to the Customer during the purchase procedure. By clicking on the button “I accept the general conditions of sale”, the Customer declares to have read and accepted these General Conditions. The acceptance of the General Conditions of sale has the value of recognition and acceptance of the set of conditions illustrated below by the Customer in the name and on behalf of the other participating subjects who will therefore be bound by these General Conditions. The acceptance of the General Conditions has the value of a definitive booking from which it will no longer be possible to withdraw, except as provided for in the following article 8. Acceptance of the offer:
In case of booking a Service via the Internet, the Customer is required to subscribe to an offer and communicate the data of his credit card, which will be processed in compliance with the provisions of Legislative Decree 196/2003 and with systems safe. The customer will be offered an estimate which can be accepted by clicking on the “Confirm” button.
EGMONT VIAGGI undertakes to do everything possible to ensure that the contract accurately reports all the details of the Customer’s booking. EGMONT VIAGGI will not be responsible for missing or incorrect data. The Customer has the duty to carefully reread the contract and possibly decide not to accept it or not to send it back signed and, if necessary, to contact our customer assistance services.

Availability of offers:

All of our online offers are normally available. A few minutes after placing the order, an e-mail confirming receipt of the booking request will be automatically sent to the e-mail address communicated by the customer during registration and the relative amount will be automatically charged to the credit card communicated. . The booking confirmation and the relative invoice will be sent by e-mail to the Client as soon as possible to confirm the booking. Should the supplier inform us that the offer subject to the reservation is no longer available, pursuant to art. 42, paragraph 1 of the tourism code, the Customer will have the right to take advantage of another tourist package of equivalent or higher quality without a price supplement or of a qualitatively lower tourist package, after returning the difference in the price, or he will be reimbursed, within seven working days from the time of withdrawal or cancellation, the sum of money already paid.

Payment and billing
Payment can be made by:

• Paypall, Credit Card, Rechargeable prepaid card of the major international circuits indicated on the payment page at the end of the booking process. For each purchase, the Customer will be charged the full amount of the order upon sending the e-mail confirming receipt of the booking request. Finally, the Customer guarantees that he is fully enabled to use the credit card he is using for the purchase and that the latter gives access to sufficient funds to cover all the costs necessary for the balance of the reservation. The debit authorization given to EGMONT VIAGGI for the payment of the reservation is irrevocable. It is therefore not permitted for the Customer to oppose the payment except exclusively in the event of fraudulent use of the same by third parties. Outside of this limited and legally regulated circumstance, the credit card holder is guilty of fraud against the credit card issuer in the event of an objection to the payment. The right to object to payment cannot replace the exclusion of the right to reconsider. The invoice is issued and simultaneously sent electronically to the customer at the time of booking confirmation. The invoice is made out to the natural person who made the booking and the name indicated on the invoice cannot be changed after sales. No invoices are issued to legal entities / holders of VAT numbers. The amount on the invoice indicates the total amount of the package which cannot in any case be fragmented or made out to several people. The VAT regime applied is indicated in art. 4 “Prices and taxes” of these conditions.

Exclusion of the right of withdrawal
Unless otherwise provided for in these General Conditions, the Customer cannot withdraw from bookings and purchases of Services made with EGMONT VIAGGI. The right of withdrawal provided for by art. 64-67 of Legislative Decree 6 September 2005, n. 206, and referred to in art. 32 paragraph 2 of the Tourism Code, is expressly excluded.

Delivery of travel documents

The methods of delivery of travel documents and / or tickets are shown on the booking confirmation communication and delivery is made according to the time interval between the date of issue of the tickets and the date of departure and / or the type of service. In the event that the Customer makes a mistake in sending their data, EGMONT VIAGGI declines all responsibility for the failure or incorrect execution of the trip due to the failure to receive the travel documents. Activities proposed during the stay.

Some proposed activities may involve risks, especially for young children. EGMONT VIAGGI is in no way responsible for accidents or injuries attributable to the Customer or to facts of third parties, or in unforeseeable circumstances or force majeure events. EGMONT VIAGGI does not guarantee that the on-site activities indicated in the description are actually provided and will not be liable in any way if these activities are canceled by the local structure that provides the service for climatic reasons, cases of force majeure, stays out of season or if it is not reached the minimum number of participants required to be able to carry out the activity.

Photo
EGMONT VIAGGI tries to offer a realistic view of the services offered through the photos and illustrations provided. The photos and illustrations shown in the descriptions, however, are purely illustrative, are provided by the owners of the services offered and may not reflect the conditions of the facilities and services at the time of booking. In any case, the aforementioned photos and illustrations do not oblige EGMONT VIAGGI except to the extent that they indicate the category or level of services. Furthermore, naturalistic photos that describe particular phenomena, such as the eruption of the Etna volcano or Stromboli, do not guarantee the actual reproduction of the phenomena themselves. LIABILITY AND WARRANTY For the use of the site EGMONT VIAGGI does not guarantee that the site is free of defects, errors or bugs, that the site will operate without interruptions or failures, or that it is compatible with all systems without exception. EGMONT VIAGGI cannot be held responsible for malfunctions due to third party software. EGMONT VIAGGI cannot be held responsible for all types of foreseeable or unforeseeable damage, material or immaterial, deriving from the use or the total or partial inability to use the site. EGMONT VIAGGI cannot control all the sites to which it has been redirected through hyperlinks, which exist only to facilitate users’ searches. EGMONT VIAGGI can therefore in no way be held responsible for their content.
By accepting these terms and conditions, the user declares to know the characteristics and limitations of the Internet, in particular as regards the technical performance of the applications that are developed and as regards the security of communications and data.

For services
Our suppliers are chosen with particular care. EGMONT VIAGGI will not be responsible in any way for failure or incorrect execution of one of the elements of the package attributable to the Customer, to a cause of force majeure, to a fortuitous event, or to a third party unrelated to the provision of the services provided for in the contract. The responsibility of EGMONT VIAGGI is however limited only to the services purchased by EGMONT VIAGGI, excluding all services purchased from third parties.

Booking cancellation and modification
Any cancellations and changes must be requested in writing info@egmontviaggi.it

The Customer who receives a modification / cancellation estimate must respond for approval within the terms indicated in the email to confirm his request. Confirmations received after the deadline may give rise to additional expenses which will be communicated via email to the Customer. In the absence of written confirmation, the reservation will be maintained as originally planned. The cancellation or modification of the reservation may result in costs charged by our suppliers, in addition to our handling fees (penalties). These costs will be deducted from the refund in case of cancellation and charged in case of modification. Expenses not included in the service and already incurred by the Customer (by way of example, but not limited to, issuing of visas, other travel documents, cost of vaccinations), will not be subject to any refund. The withdrawal from the contract, for any reason whatsoever, will not exempt the Customer from the full payment of the sums due to the company EGMONT VIAGGI UNIPERSONALE S.R.L. Stays interrupted, shortened or services not consumed for any reason, including no-show or late presentation, will not be entitled to any refund. We remind you that, every time the Customer takes out insurance to cover the costs in the event of cancellation, it is up to the Customer to notify the insurer directly of the cancellation or of the accident, based on the conditions and terms indicated in the contract shown on the site.

Penalties in case of cancellation
The penalties in case of cancellation vary according to the service providers (by way of example but not limited to, hotels, airlines, tour operators, local intermediaries) who participated in the realization of the trip. Unless otherwise indicated in the description of the booked trip, the penalties indicated below will apply.

Exceptions:
Some commercial offers, regardless of the type of product and by virtue of a greater discount on the final price proposed to the customer, may contain conditions different from those present in the above prospectus. These conditions will be expressly indicated in the product sheet for sale and will form an integral part of the travel contract.

Cancellation due to the service provider
In the event that EGMONT VIAGGI is forced to cancel the trip, the Customer will be notified immediately and will have the right, at their choice, to (a) take advantage of another tourist package of equivalent or higher quality at no extra cost; (b) take advantage of a qualitatively lower tourist package, after refunding the difference in price; or (c) to obtain reimbursement, within 48 working hours from the moment of communication of the cancellation, of the sum of money already paid. If the customer books a tour or a stay, the reservation may be subject to reaching the minimum number of participants. In case of cancellation due to lack of the number of participants, EGMONT VIAGGI will notify the customer in good time.

Protection of personal data
EGMONT VIAGGI undertakes to comply with the applicable regulatory rules regarding the safety and protection of personal data also in order to guarantee safe, controlled and confidential navigation.
In order to ensure constant compliance with the applicable laws, in the event of their change and updating, this article on the protection of personal data may be modified. For this reason, EGMONT VIAGGI invites the Customer to carefully read the rules governing the collection and processing of personal data.
The data provided by the Customer to EGMONT VIAGGI on the Site during the registration phase and every time a purchase is made on the Site are treated in compliance with the provisions of Legislative Decree 196/2003.
The personal data provided by the Customer will be processed with paper, electronic or in any case automated tools. Owner of the processing of personal data EGMONT VIAGGI with headquarters in Via Francavilla 387 98039 Taormina (Me).
The data communicated by the Customer are processed for the following purposes:

1. collection, storage and processing for the purposes of establishing and operational and administrative management of the contractual relationship connected to the provision of the Services offered by EGMONT VIAGGI;
2. use of data by EGMONT VIAGGI to communicate via e-mail, telephone or fax relating to the performance of the contractual relationship established.

With the Customer’s consent, the Customer’s personal data may also be processed for the purpose of sending promotional-advertising communications.
Personal data may be processed by and communicated to: employees and / or collaborators who provide assistance and advice to EGMONT VIAGGI as well as by persons in charge of maintenance of the company network and of the hardware and software equipment in use; airlines, hotels, car renters, insurance companies and all other subjects to whom the transmission is necessary for the execution of the contract; subjects whose right to access data is recognized by law or by orders of the authorities; subjects delegated and / or appointed by EGMONT VIAGGI to carry out the activities related to the provision of the Services.
The Customer’s personal data will not be disclosed or communicated outside the cases highlighted above.

Complaints and customer support
Any claim for failure or incorrect execution of the contract must be reported by the Customer on site to the organizer of the package without delay, so that the organizer can promptly remedy it. If the customer has not received any feedback, he can also make a complaint by sending a registered letter, with acknowledgment of receipt, to the organizer and to EGMONT VIAGGI in Via Francavilla 387 – 98039 Taormina no later than 10 working days from the date of the return to the place of departure. Complaints received after the deadline will not be followed up.
Before making any booking, the Customer is required to inquire about any local events such as, by way of example, the carnival, religious holidays, national holidays, holidays, fairs that could compromise the success of the trip. In this regard, no further complaint can be made to the company EGMONT VIAGGI.
EGMONT VIAGGI undertakes to send the Customer as soon as possible and in writing a receipt of the delivery of the communication and of the fact that the matter has been entrusted to the competent service. In most cases, the final answer will depend on how long it will take for interested suppliers to respond. Telephone complaints or disputes will not be accepted. The costs for the communication of disputes will be borne by the Customer.
In the event of loss or damage to baggage during air transport, the Customer is required to contact the airline before making any complaint to our assistance service:
making you ascertain the loss or deterioration of your baggage before leaving the airport;
subsequently filing a complaint, to which the originals of the following documents must be attached: ticket, declaration of loss, receipt of baggage registration.
In case of loss or damage of baggage during air transport or in case of flight delay, if the Customer has taken out insurance to cover these risks, he is required to file a complaint with the insurance company within the deadline set out in the said contract. The insurance company will only accept applications accompanied by all the supporting documents required by the contract.

Applicable law
These General Conditions and the relationship between the Customer and EGMONT VIAGGI are governed by Italian law, including the Tourism Code and Legislative Decree 6 September 2005, n. 206 containing the Consumer Code, for the part relating to distance contracts.

Trademarks and Intellectual Property Rights
All the contents of the Site, such as but not limited to, texts, graphics, trademarks, logos, icons, images, audio tracks, databases, software (and related source codes) are protected by the Industrial Property Code, Legislative Decree. 30/2005, by the law on copyright, l. 633/41, as well as other applicable laws on industrial and intellectual property. The aforementioned industrial and intellectual property rights are the exclusive property of EGMONT VIAGGI, or its suppliers, who grant them management to EGMONT VIAGGI under an express license. Without the written consent of EGMONT VIAGGI, therefore, the user cannot, in any way, means or form, copy, modify, change, publish, publicly promote, distribute, sell or transfer any material, database or program strings present on the Site, neither in part nor in whole.
